UYUŞMAZLIK KONUSU OLAN VE HENÜZ SINIRLANDIRILMAMIŞ DENİZ ALANLARINA İLİŞKİN DEVLET YÜKÜMLÜLÜKLERİ

Abstract

Uluslararası Hukuk’un en önemli konu ve sorunlarından bir tane-si de deniz alanlarının sınırlandırılması meselesidir. Bu mesele, siyasi ve ekonomik yönleri olan karmaşık bir meseledir. Ulusal egemenlik veya egemen haklarla yakından ilgili olduğundan kamuoyunda da ciddi dikkat çeken bir konudur. Bu çalışmanın amacı bu meselenin bir yönünü ele almaktır. Burada sınırlandırmayı nihai olarak sona erdiren bir anlaşma veya karardan önce tarafların, söz konusu uyuşmazlığın konusunu oluşturan deniz alanlarına ilişkin davranış yükümlülüklerini tespit eden BMDHS’nin 74. ve 83. maddelerinin ortak 3. fıkrası önemli kazanmaktadır. Bu çalışmada bu madde bağlamında ortaya çıkan davranış yükümlülüklerinin ne olduğu ortaya konulacaktır.
